Prosecution For Contravening A Housing Act 2004 Prohibition Order

At Llandudno Magistrates Court today (09/04/19) Mr Peter Tscherewik of Rose Hill, Fernbrook Road, Penmaenmawr was found guilty of twice contravening a Housing Act 2004 Prohibition Order served against the building.

Mr Tscherewik was fined £120.00, ordered to pay £200.00 costs, and a victim surcharge of £30.00. A total of £350.00. 

A Housing Act Prohibition Order became effective on the property on 27/12/17 due to unsatisfactory living conditions. This Order limited the occupation of the property to one single person. On 09/10/18 and again on 06/02/19 he was found to have contravened the Order by allowing persons other than himself to continue to reside in the building.

Cllr Mark Baker, Cabinet Member for Regulation, said “Landlords should be aware of their legal duty and responsibility to ensure that their tenants live in decent and safe homes. Officers of this Authority will deal robustly with landlords that don’t carry out their duties or fail to comply with the requirements of Notices served upon them.”
